International law until the mid-20th Century, was, in the words of the great international lawyer Ludwig Oppenheim at the opening of that Century, “the name for the body of customary and conventional rules which are considered legally binding by … States in their intercourse with each other.”
In other words, it is a body of law regulating interactions between states. An example would be laws regulating aviation, including the use of airspace and safety aboard planes; laws allowing us to send and receive post across the globe; and laws designed to prevent the proliferation of nuclear weapons. This body of law, Oppenheim claimed, could afford no protection to individuals, since international law was concerned only with relations between states.
Oppenheim wrote this in the early 1900s. His words were echoed by many other international lawyers at the time; it was widely understood that individuals had no place in this field of law. In fact, as Frans Viljoen has claimed, international law actually “supported and colluded in” the commission of some of the worst human atrocities of all – eg the Atlantic Slave trade and colonialisation.
